1. About CrossRide

CrossRide is a ride-sharing and parcel delivery platform connecting drivers and passengers. CrossRide is operated by CrossRide OÜ, an Estonian company registered at Lõkke tn 4, 10122 Tallinn, Kesklinna linnaosa, Harju maakond, Estonia, registration number 17500416 (hereinafter "CrossRide", "we", "us").

The processing of users' personal data is governed by our Privacy Policy, in accordance with the General Data Protection Regulation (GDPR — EU Regulation 2016/679).


2. Acceptance of Terms

By accessing or using the CrossRide platform (website or mobile app), you agree to be bound by these Terms of Service. If you do not agree, you must stop using the platform immediately.

These Terms apply to all registered users and visitors, whether drivers, passengers, or parcel senders.


3. Account Registration and Identity Verification

3.1 Account Creation

You must create an account with accurate, complete, and up-to-date information. You are solely responsible for maintaining the confidentiality of your login credentials.

3.2 Mandatory Identity Verification (KYC)

Before publishing or booking any paid ride, all users must complete identity verification via Stripe Identity (valid government-issued ID + real-time selfie). Identity verification is a prerequisite for accessing payment, refund, and booking features. CrossRide reserves the right to suspend or delete any account that fails verification.

3.3 Age Requirement

  • Driver: minimum 18 years old — the legal age to hold a driving licence
  • Passenger: minimum 16 years old — written parental consent required for users aged 16–17; 18 years without condition

By registering as a driver, you confirm you are of legal age. By registering as a minor passenger (16–17), you confirm you have obtained your legal guardian's consent.


4. Services

4.1 Ride-Sharing

CrossRide enables drivers to offer seats in their vehicle for trips they are already making. Passengers can search and book these seats. CrossRide acts as an intermediary only and is not a party to the transport contract between driver and passenger.

4.2 Parcel Delivery — General Rules

CrossRide enables parcel sending via drivers making a matching trip. Three capacity tiers are available:

  • SMALL: up to 5 kg (documents, small packages)
  • MEDIUM: up to 15 kg (luggage, boxes)
  • LARGE: up to 30 kg (bulky items, multiple boxes)

4.3 Parcel Delivery — Prohibited Items

The following items are strictly prohibited from being sent via CrossRide:

  • Weapons, ammunition, and dangerous objects
  • Narcotics and illegal substances
  • Flammable, explosive, or corrosive products
  • Live animals
  • Cash, cheques, or banknotes
  • Items valued above €300 (jewellery, high-end electronics, artwork)
  • Official documents (passports, residence permits, driving licences)
  • Unpackaged perishable food items
  • Any item whose transport is prohibited under applicable law

Violation of this list is the sole responsibility of the sender and may result in permanent account suspension.

4.4 Parcel Delivery — Liability

CrossRide is not a carrier and assumes no liability for the loss, deterioration, theft, or damage of parcels transported through the platform. The parcel transport contract is concluded exclusively between the sender and the driver. CrossRide acts solely as an intermediary.

In the event of a parcel dispute, CrossRide may, in good faith, facilitate mediation between the parties. This does not constitute any acknowledgement of liability.

Sending valuable items via CrossRide is strongly discouraged. Any sender who chooses to do so assumes all associated risk.

4.5 CrossRide Urgent

For trips needed within 2 hours, CrossRide offers an urgent matching service. The base price is calculated according to CrossRide's standard dynamic pricing. Urgent surcharges are then applied on top of this base price:

  • Departure within 2 hours: +20%
  • Departure within 1 hour: +40%
  • Departure within 30 minutes: +70%

Surge rates are fixed and fully transparent. They are displayed before booking confirmation.


5. Pricing and Commissions

5.1 Platform Commission

  • Standard trips: 15% of the final trip price (driver receives 85%)
  • Urgent trips: 20% of the final trip price (driver receives 80%)

These rates apply to the final price paid by the passenger. Any future modification will be notified at least 15 days before taking effect (see section 13). No hidden fees are applied.

5.2 Transparent Dynamic Pricing

The driver sets a floor price. The CrossRide algorithm may suggest a higher price based on demand and supply but will never go below the driver's floor. The commission is charged on the final price paid by the passenger.

Every listing shows in real time: current price, remaining seats, price trend, and the exact reason for any price change.

5.3 Payment Processing Fees

Stripe processing fees (~1.5% for European cards) are included within CrossRide's commission.


6. Payments

Payments are processed by Stripe (Stripe Payments Europe, Ltd.). CrossRide never stores your card data. Payment is authorised at booking and captured upon driver confirmation.


7. Refund Policy

7.1 General Rule

Automatic refund granted when:

  • Driver confirms the trip did not take place
  • No drop-off confirmation within 2 hours AND GPS confirms no trip occurred

Human review: A CrossRide team member reviews all objective evidence (GPS, timestamps, statements, history) within 24 hours. CrossRide rules exclusively based on objective data, to the exclusion of subjective considerations. Its decision is final within the platform, without prejudice to legal remedies.

7.3 Processing

Approved refunds processed via Stripe within 24 to 48 hours.

7.4 Fraud Protection

New accounts submitting a refund request within their first 3 trips may be preventively suspended for 24–48 hours pending human review. This is an anti-fraud measure, not a final decision.


8. User Obligations

All users: accurate information, no illegal use, respectful behaviour, no multiple accounts, no payment circumvention.

Drivers: valid driving licence; valid insurance covering passenger ride-sharing (proof on request — note: standard legal insurance generally does not cover parcels, which remain the driver's sole responsibility); highway code compliance; confirm drop-off via app; no more passengers than booked; refuse any suspicious parcel.

Passengers: be on time at pick-up location; respect driver and vehicle.

Parcel senders: guarantee contents comply with section 4.3; pack securely; bear full responsibility for undeclared or illegal contents.


9. Rating System

Drivers and passengers may rate each other within 48 hours of the trip. Ratings below 3 stars must include a written reason. CrossRide detects abusive ratings.


10. Liability

10.1 Intermediary Role

CrossRide is not a carrier and cannot be held liable for accidents, delays, losses, or damages during a trip.

10.2 Limitation of Liability

CrossRide is not liable for indirect damages including loss of income, lost data, or service interruptions.

10.3 Insurance

CrossRide does not provide insurance. Each driver is solely responsible for maintaining adequate coverage for ride-sharing.


11. Intellectual Property

The CrossRide platform, logo, design, and content are the exclusive property of CrossRide OÜ. Reproduction without written authorisation is prohibited.


12. Suspension and Termination

CrossRide may suspend or terminate an account in the event of:

  • Violation of these Terms
  • Confirmed or suspected fraudulent behaviour
  • Sending prohibited items via the parcel service
  • Average rating below 3.0 out of 5 over 6 consecutive months
  • Failure to renew required identity verification

13. Changes to These Terms

Users notified at least 15 days before any changes take effect. Continued use constitutes acceptance.


14. Governing Law and Jurisdiction

These Terms are governed by Estonian law, without prejudice to mandatory consumer protection rules of the user's country of residence. A user in Belgium benefits from Belgian consumer law protection.

Disputes submitted to the competent courts of the consumer's place of residence (Regulation (EU) No 1215/2012).
